Institutional models of labour mediation: A comparative legal analysis of procedural safeguards, enforcement and regulatory design

This project assesses mediation as an approach to resolve labour disputes in ten European jurisdictions through a systematic comparative study. In addition to using comparative studies to describe the labour dispute resolution processes across different countries, this research uses four variables to measure how mediation was designed institutionally: procedural obligation (mandatory vs. voluntary), institutional embedding (court-attached vs. institutionalized), enforcement mechanisms, and professional accreditation frameworks. The research combines doctrinal legal analysis with a structured comparative assessment of approximately 200 judicial decisions, 1,500 legislative and regulatory instruments, institutional documentation, and qualitative practitioner perspectives in order to identify recurring institutional patterns across labour mediation systems. Particular attention is given to the interpretation of Article 47 of the Charter of Fundamental Rights of the European Union (CFREU) and the jurisprudence of the Court of Justice of the European Union concerning mandatory mediation and effective judicial protection. The study’s data show that whether participation is mandatory or voluntary does not determine mediation’s ability to produce effective settlements. Instead, mediation’s ability to sustain settlements and ensure compliance after mediation are significantly related to the design of enforcement mechanisms, judicial or administrative validation mechanisms, and the credibility of the institutions conducting mediation. Court-attached and institutional mediation can produce durable settlements if they are embedded in a coherent regulatory structure. However, having formal compulsion without an enforceable framework is no more likely to produce better results than other approaches. The study contributes to comparative labour law by treating mediation as a context-dependent institutional construct instead of a procedural model to be transferred. The study recommends that labour law reform prioritize structural integration, enforceability, and professional regulation over whether participation is voluntary.
