Resumen

Civil dispute resolution is an important issue in providing guarantees for law enforcement in terms of contracts and investments. The end of dispute resolution in court is civil execution, which often encounters problems. Business actors and investors must be assured that the Indonesian government has a legal tool that can ensure the governance of dispute resolution when there is a violation of contracts or investments. Therefore, the problem that will be solved in this study is what the obstacles are in the model of implementing civil execution in court and how the obstacles are based on the role of other institutions involved. The goal is to analyze the obstacles to execution from inside and outside the court to overcome the long and difficult execution. The obstacles to execution that were successfully identified involved security obstacles at the police, the implementation of auctions at the auction office, and the checking of ownership documents at the land office. Based on the findings, a policy framework that can optimize the governance of dispute resolution services and ensure the success of the implementation of civil execution is necessary.
