A Trick of the (Virtual) Trade: a study on the challenges posed by cross-border e-commerce for national patent systems

Resumen

El crecimiento del comercio electrónico transfronterizo crea un mercado global accesible a todos, empresas y consumidores por igual. El alcance internacional del comercio electrónico plantea desafíos únicos a los titulares de patentes, ya que la actividad infractora puede producirse a escala transnacional mientras que los innovadores deben confiar en sistemas de patentes confinados geográficamente. En este contexto, el presente estudio pretende explorar los retos que plantea el comercio electrónico transnacional a los derechos de los titulares de patentes y evaluar algunos de los puntos más importantes para combatir la infracción transfronteriza. A través de la revisión bibliográfica realizada, los resultados apuntan a que las dificultades asociadas a la resolución de casos de infracción en un contexto transfronterizo han llevado a los jueces nacionales a encontrar soluciones «creativas» al problema de la infracción transnacional. Las conclusiones extraídas de este estudio sugieren que el paradigma comercial actual exige una reevaluación de la naturaleza «nacionalmente confinada» de los sistemas de patentes.
